Sperm donor may be on the hook for child support

In a case believed to be the first of its kind, a 47-year-old man from Kansas has been ordered to pay child support for the daughter of a lesbian couple for which he was the sperm donor. The man answered a Craigslist ad from two lesbian women looking to conceive a child. He apparently gave the women free sperm donations out of altruism and proceeded to waive all parenting rights. However, a district court recently ruled that the man must pay back $4,000 in public aid that the state has provided for the girl, who is now 4 years old. He must also provide child support payments. The man states that he and the women had a contract and that the state is simply "undoing a family." Attorneys for the man intend to appeal the decision.

The lawsuit, filed in May of 2013, was brought by the state of Kansas on behalf of the state's Children and Families department. The suit sought a summary judgment against the man for allegedly breaking a Kansas law stating that sperm donations must be conducted under a doctor's supervision. An attorney for the man said that Kansas needs to update the law so that same-sex families are recognized in sperm donation statutes. He also stated that the ruling was motivated by politics, as Kansas currently has a state constitution that forbids same-sex marriages.

While Illinois does currently recognize same-sex marriages, it might be difficult to find a clear legal precedent if such a case were to arise in the state. In some situations, the person that receives child support payments must seek legal help in order to get the full amount that they are due. This case, however, demonstrates the fact that people who are forced to make payments might also need an attorney if they feel their situation is unjust.
