Child support issues in Illinois are governed by law

Child support issues in Illinois have been brought out into the forefront in recent years. Laws and statutes governing the implementation of rules that parents must follow have provided guidance. 750 of the Illinois Compiled Statutes, Chapter 40, outlines the picture of child support for us and what the law says about it.

The legislature has made it easier for the court system to get child support flowing quickly after a divorce. It quickly allows for the proof of parentage to occur and allows for the administration portion of the support to be expedited so that the best interests of the child are at the heart of the law and the court ruling.

Many times, the truth doesn't come out at the outset of the divorce filing. There are often factors that, in the rush of things, get overlooked. You may want to contact a legal professional who knows the right questions to ask and how to get your side of the story heard by a judge.

The Illinois Supreme Court has the right to hear any case it chooses to when it comes to child support issues; however, they more often than not defer to lower courts and expect the lower courts to use their best judgment when making decisions that affect not only the parents involved but any children as well.

Not being aware of the ruling that the legislature of Illinois has put into practice is no excuse for not following it. In other words, not being aware of a law makes it no less of a law and the Supreme Court expects the lower courts to perform under the statutes and rules that govern them to the fullest capacity of that law.
