Child custody issues in Illinois

During the divorce of two parents, tough decisions must be made with regard to parenting time, child custody and other matters. Indeed, it is never easy to make a decision that will result in spending less time with one's children, but in cases of joint custody parents have little choice. Compromises must be made, and it is always hoped that the decisions will be made with the best interest of the child in mind.

Fortunately, Illinois courts also subscribe to the philosophy of making decisions in the best interest of the child. They also recognize that children are best served when they have constant and regular contact with both parents. Therefore, even if a child custody disagreement explodes into a full-blown court battle, courts will lean toward joint custody arrangements that allow the child to spend equal time being raised by both parents.

That said, equal parenting time is not always possible and it is not always in the best interest of the child. For example, if one of the parents is suffering from drug addiction or has been convicted of a serious crime, courts may see that parent as a danger to the child and strip the parent of his or her custody rights. Such decisions are never made in haste, though, and courts will consider arguments from both sides when making such a determination.
