Stand up for your right to a fair custody agreement

Going through divorce can sometimes be an emotional and complex process, especially if you have children whose future you will need to decide. As many couples in Illinois experience every year, this is often a hard agreement for parents to reach. The chances are that you and your spouse both want to remain a significant part of your children's lives, but now their time must be split between you.

If you cannot reach an agreement with your spouse, then the matter will be settled by the court. The final decision can then depend on a variety of factors. This can include your relationship with your children, your perceived contribution as a caregiver in their lives and your ability to support them. Depending on the age of your children and their apparent capacity to make a reasoned decision, their preference may also factor in the decision.

There are multiple configurations of custody agreement that might be reached, some awarding primary physical custody to one parent or the other, while affording visiting rights to the non-custodial parent. In other cases shared custody may be recommended, meaning that your children's time will be divided evenly between both parents and you will each have equal responsibility for their care.

It is difficult not to become emotional and reactionary when fighting for your right to spend time with your children, but it is important to keep their best interests at heart and maintain a level head.
