Child custody: what happens if one parent abducts a child?

The process of divorce can be emotionally debilitating. Both parents are fighting over issues of property division, child support, alimony and child custody. Even after everything is settled, emotions can run wild and lead parents to do things that defy reason. Oftentimes, one parent is upset about how the courts decided a custody agreement and let their anger get the best of them. They might choose to take matters into their own hands, which is never a good idea.

As hard as it is to accept, some parents have even resorted to kidnapping a child to keep him or her for themselves. This can be incredibly frightening for the parent with physical custody, who may wonder what recourses are available. Fortunately, law enforcement treats child custody violations with the utmost urgency and will do everything in its power to find the child and bring the other parent to justice. This can include jail time, major fines and the loss of any rights to visitation or custody the abducting parent might have had in the past.

In addition, the parent with physical custody can ask the courts for an adjustment of the custody order to reflect the actions of the other parent, taking away his or her rights to see the child, either permanently or temporarily.

 If the child is taken across the border to another country, committing an international abduction, things can get even messier. In these cases, the other parent may want to consider speaking with an attorney who has experience in child custody cases.
