Will a property checklist actually help during my divorce?

Divorces typically run high with emotion, stress and sometimes, even anger. With the combination of these things weighing on the minds of spouses, it is no surprise that the finer details of a divorce sometimes get lost in the mix. Confusion and frustration can make individuals forget about important items when dividing property, so when spouses are given the opportunity to create a checklist, they should take it.

Many times a property checklist will be required by both parties, during the exchange of financials, at the time of discovery. The information gathered at this point is used to create the division of property order. It helps the process if both spouses turn in a similar property checklist, but if property is missing, or the list is incomplete, a fair or even distribution of property is near impossible.

For divorcing couples, it would help to begin the property checklist early on. Whether you use a standard list provided by an attorney or create your own, adding to it over the course of a few days may prevent you from forgetting important items. It may help to remember that, as daunting as the process is, this list is supposed to include all the property you own, and rightfully should take a great deal of time to create. By rushing the process, you risk losing important items in the division of property.
