Be prepared for child support modifications

In our last post, we talked about child support in the state of Illinois and how some court orders need to be enforced due to an unwilling or irresponsible parent. Today, we will continue this conversation by talking about modifying a child support order or agreement.

When your child support arrangement is made, you may think that the provisions and rules of the order will remain constant. This would be nice, as it would simplify your post-divorce life and give you some consistency. However, life is not like that. Things change all the time, and as a result of that change your child support arrangement needs to be modified to reflect the new reality of your life.

For example, what if one of the parents loses their job? What if they receive a significant raise, or their salary is cut down by a substantial margin? What if one of the parents reaches retirement? These circumstances warrant a modification to the child support order.

Additionally, there could be times where extraordinary expenses are involved in your life. Say your child has special needs – well then your child support arrangement needs to reflect this reality.

And how about when your child turns 18? Now that he or she is an adult, the child support order should end. However, if you are the paying spouse, you should not think that the order absolves itself. Instead, you have to take action to legally terminate the obligation.

Modifying a child support order over time will likely be a task you have to deal with after a divorce. Prepare yourself for such a moment by asking questions and talking with your family law attorney.
