Discussing spousal maintenance, and what it means in Illinois

When a couple files for divorce, one of the factors that may be involved in their split is spousal maintenance. This is commonly referred to as "alimony," but the legal term is spousal maintenance. This form of financial support helps someone who is trying to rebuild his or her life after a divorce.

Not every divorce will have spousal maintenance included. Even the divorce agreements that do have spousal maintenance will go through an analysis of many factors – 12 in total in the state of Illinois – to determine how much maintenance should be paid, for how long and in what context.

Spousal maintenance, when awarded, has a major impact on both people. The paying individual will obviously have a new financial obligation, but he or she will also be able to deduct those payments from his or her taxable income. The receiving spouse will be buoyed by the maintenance payments, allowing him or her to move forward after the divorce. But the receiving individual will also have to include the maintenance payments as part of his or her taxable income.

Taxable income is just one way in which spousal maintenance has an impact on divorcing couples. If you are going through a divorce and are curious about spousal maintenance, how it works and if it could be included in your case, talk with an experienced family law attorney. At Goddard & Malmquist, we can help couples going through a divorce as they look to address the issue of spousal maintenance.
