Collaborative divorce, mediation and the power of choice

There are a number of ways that a splitting couple can go about a divorce. The "traditional" method is to file for divorce and await a judge's decree on how some of the issues in your divorce will be resolved. While this may be the way that a couple wants to go through with their divorce, it robs the couple of the chance to make a customized agreement that fully considers their desires and wishes for their divorce agreement.

This is why there are two other options for fulfilling your divorce: collaborative divorce and mediation.

Collaborative divorce is a process that sees the spouses retain their own attorneys. These attorneys need to be specially trained for the collaborative process. During the collaborative divorce, you, your soon-to-be-ex and your attorneys will meet and discuss the issues involved in your divorce. You can compose a creative divorce agreement that address all of your concerns, and you can even use collaborative divorce to address post-divorce decrees and modifications.

Mediation is a little different. Instead of each spouse having an attorney to help them address issues in their divorce meetings, the spouses agree to have one specially trained attorney to be their mediator. The mediator then helps the two splitting spouses communicate and address their divorce concerns in an effective manner.
